PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE DOWNLOADING OR USING THIS SOFTWARE. BY CLICKING ON THE "ACCEPT" BUTTON, OPENING THE PACKAGE, DOWNLOADING THE PRODUCT, OR USING THE EQUIPMENT THAT CONTAINS THIS PRODUCT, YOU ARE CONSENTING TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, PLEASE EXIT THE INSTALLATION PROCESS NOW. IN ADDITION: (1) IF YOU PURCHASED THE PRODUCT, RETURN THE PRODUCT TO THE PLACE OF PURCHASE FOR A FULL REFUND; OR, (2) IF YOU ARE OTHERWISE ATTEMPTING TO DOWNLOAD THE PRODUCT AND YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, DO NOT COMPLETE THE DOWNLOAD; OR, (3) IF YOUR SOFTWARE WAS INCLUDED IN EQUIPMENT WHICH YOU PURCHASED AND YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.

This Limited Use Software License Agreement (the "Agreement") is a legal agreement between you ("Licensee"), the end-user, and Gary Duke a.k.a. littlebig mobile entertainment ("Gary Duke"). By using this software or storing this program on a computer hard drive (or other media), you are agreeing to be bound by the terms of this Agreement.

The Program (e.g. the PRC file) and included or accompanying documentation are protected by copyright laws as well as other intellectual property laws and treaties. "littlebig mobile entertainment" is a trade name and trademark of Gary Duke. The littlebig logo is a trademark of Gary Duke. The Program and the accompanying documentation are licensed, not sold, to you. This includes any updates or upgrades to the Program licensed to you by Gary Duke. You agree to use your best efforts to prevent and protect the contents of the Program and Documentation from unauthorized use or disclosure.

You may not alter this software in any way, including changing or removing any messages or windows.

You may not decompile, reverse engineer, disassemble or otherwise reduce this software to a human perceivable form. You may not modify, rent, lease, sell or otherwise transfer or distribute this software: YOU ARE NOT AUTHORISED TO DISTRIBUTE THIS SOFTWARE BY WAY OF PALM SOFTWARE SITES, MAGAZINES, COMPILATION CDs WITHOUT EXPRESS PERMISSION FROM GARY DUKE). You MAY NOT CREATE DERIVATIVE WORKS BASED ON THIS SOFTWARE.

This license is effective until terminated. You may terminate this license at any time by destroying the Program, Documentation as well as each backup copy. Without prejudice to any other rights, Gary Duke may terminate this EULA if you fail to comply with the terms and conditions of this EULA.

THE SOFTWARE IS PROVIDED TO LICENSEE "AS IS". ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

THIS SOFTWARE IS NOT FAULT TOLERANT AND SHOULD NOT BE USED IN ANY ENVIRONMENT WHICH REQUIRES THIS, SUCH AS ON-LINE CONTROL OF AIRCRAFT.

TO THE EXTENT NOT PROHIBITED BY APPLICABLE LAW, GARY DUKE'S AGGREGATE LIABILITY TO LICENSEE OR TO ANY THIRD PARTY FOR CLAIMS RELATING TO THIS AGREEMENT, WHETHER FOR BREACH OR IN TORT, WILL BE LIMITED TO THE FEES PAID BY LICENSEE FOR SOFTWARE WHICH IS THE SUBJECT MATTER OF THE CLAIMS. IN NO EVENT WILL GARY DUKE BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT (INCLUDING LOSS OF BUSINESS, REVENUE, PROFITS, USE, DATA OR OTHER ECONOMIC ADVANTAGE), HOWEVER IT ARISES, WHETHER FOR BREACH OR IN TORT, EVEN IF GARY DUKE HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. LIABILITY FOR DAMAGES WILL BE LIMITED AND EXCLUDED, EVEN IF ANY EXCLUSIVE REMEDY PROVIDED FOR IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.

This EULA shall be governed by in accordance with the laws of Canada.
